The bipartisan budget passed by the House and Senate and signed by President Barack Obama earlier this week has a big line-item for all employers. According to James Curtis and Patrick Joyce of Seyfarth Shaw, it has provisions that will raise Occupational Safety and Health Administration penalties for the first time in 25 years.

“The budget allows for an initial penalty ‘catch up adjustment,’ which must be in place by Aug. 1, 2016,” explain Curtis and Joyce. This will be calculated in relation to the difference between the Consumer Price Index of October 1990 and October 2015, they say. “Based on recent CPI trends, the increase will likely be in the range of 70 percent-80 percent over current penalty amounts.”
