Voting rights may not be on the top of the list for employers right now, after all, the presidential election is a year away. But Christina Kennedy of Foley & Lardner warns employers to think again. “Employers must be mindful of smaller elections that take place across the state and municipal levels. And, these elections are not just held in November,” she says.

“Elections, however small, may trigger an employer’s obligations to give employees leave to vote,” explains Kennedy. The problem is that there is no uniform law throughout the country. Some states require employees to be granted a set amount of time off to cast ballots, while others mandate the time off must be paid, says Kennedy.
