John G. Loughnane, CIPP is a partner in the Corporate and Transactions Department of Nutter McClennen & Fish LLP in Boston and has more than 25 years of experience focused on growing and restructuring companies, including serving as regional corporate counsel (North America) for PTC, a technology company. Mr. Loughnane served as co-chair of ABI’s Technology & Intellectual Property Committee and on the Special Projects Task Force of ABI’s Mediation Committee. He has mediation training and practice.

Mr. Loughnane is a leader in several national organizations, including the American Bar Association, for which he is a Steering Committee member of its Legal Technology Resource Center, and the Turnaround Management Association (TMA), for which is a former trustee of TMA Global and a past president of its Northeast Chapter. He also is an active member of the Boston Bar Association and past co-chair of its Bankruptcy Section.

Mr. Loughnane is a member of Infragard and speaks and writes regularly on dealing effectively with disruption in negotiating, structuring and enforcing deals. He also has served as a board member of the George Washington University Law Alumni Association and as president of the Holy Cross Club of Boston, and he currently is president of the Holy Cross Lawyers Association.

Following his graduation from law school, Mr. Loughnane clerked for Hon. Ronald R. Lagueux of the U.S. District Court for the District of Rhode Island. He is admitted to practice in Massachusetts, New York, the U.S. Court of Appeals for the First Circuit and the U.S. Supreme Court.

Mr. Loughnane received his A.B. from the College of the Holy Cross and his J.D. with honors from the George Washington University Law School

Bob Litt, former General Counsel for the Director of National Intelligence, is of counsel in Morrison & Foerster’s national security and global risk & crisis management practices. He advises industry-leading organizations on sensitive national security and privacy matters, white collar investigations, and government enforcement actions.

Mr. Litt has extensive experience advising clients on national security matters, including those in relation to the Committee on Foreign Investment in the United States (CFIUS). In addition, he also has significant experience in civil and criminal litigation as well as investigations. He is also an Adjunct Research Scholar in Columbia Law School's National Security Law Program.

Prior to joining Morrison & Foerster, Mr. Litt was General Counsel for the Office of the Director of National Intelligence (ODNI), giving him a strong understanding of the intelligence community and its equities. Mr. Litt was unanimously confirmed by the Senate for this role, in which he oversaw a team of attorneys providing legal advice to the agency and led interagency national security meetings.

As spokesman for the intelligence community both domestically and overseas on issues relating to surveillance and privacy, Mr. Litt was a key member of the U.S. team that negotiated the EU-U.S. Privacy Shield with the European Commission. This experience uniquely positions him to advise U.S. companies on the intricacies of European privacy rules and foreign companies on U.S. privacy rules.

Prior to joining ODNI, Mr. Litt worked at the Department of Justice, serving as Deputy Assistant Attorney General in the Criminal Division and as the Principal Associate Deputy Attorney General. He also served as special advisor to the Assistant Secretary of State for European and Canadian Affairs. Bob was also an Assistant U.S. Attorney for the Southern District of New York.

In addition to his prolific government service, Mr. Litt has also had an extensive career in private practice as a partner at two global law firms, including leading a white collar practice. He began his legal career as a law clerk for Judge Edward Weinfeld in the Southern District of New York and for Justice Potter Stewart of the U.S. Supreme Court. He holds a B.A. from Harvard College and an M.A. and J.D. from Yale University.

Tinamarie Feil is co-founder and the President of Client Services of BMC Group. Tinamarie has 30 years experience directing various aspects of corporate compliance, communications, insolvency case administration, as well as the due diligence process in major merger & acquisition transactions. She currently sits on the Board of Directors of the American Bankruptcy and is Committee Leader of IWIRC’s delegation to the United Nations Committee on International Trade Law (Working Group V, Insolvency). Tinamarie is a frequent author and speaker. Articles she has authored include “Planning a Smooth Chapter 11 Distribution Process;” “Quick, or Not So Quick, Sales Under Chapter 11;” “What About the Cloud;” "Concerns Surrounding the Transmission of Personally Identifiable Information;" and co-authored "Claims Trading Promotes Ownership Concentration.”

Tinamarie is an active member of Turnaround Management Association, the American Bankruptcy Institute, the Association for Corporate Growth and INSOL International. In addition, Ms. Feil is committed to community service, mentoring, and physical and mental well-being. Her favorite organizations include Kids Co., Ronald McDonald House and Step Up Women's Network. Ms. Feil is based in New York.

The Honorable Frank J. Bailey, Chief United States Bankruptcy Judge for the District of Massachusetts, was appointed on January 30, 2009 and was appointed Chief Judge in December 2010. His chambers are in Boston and he is assigned to the Eastern Division. He spent twenty-two years as a partner at the firm of Sherin and Lodgen LLP where he served as the Chairman of the Litigation Department and as a member of the firms management committee. At the firm his practice focused on complex business litigation and business bankruptcy. He often represented clients in the medical device, pharmaceutical and high technology businesses.
