The Internet of Things and Other Emerging Data Sources: Where Privacy, Proportionality, and Technology Intersect

Richard Y. Cheng is a partner at DLA Piper, based out of its Dallas office. He is a member of the health care industry sector and the corporate practice group. Richard provides legal representation and advises on corporate transactions, health care operations, regulatory issues, compliance matters, and administrative appeals. In addition, he regularly advises clients on Stark Law, Anti-kick back, HIPAA, FCA, EKRA, HITECH Act, OIG exclusions, civil monetary penalties (CMPs). Medicare-related transactions (e.g. CHOWs), licensure surveys, formation of management services (MSOs), group purchasing organizations (GPOs), managed care organizations (MCOs) payment matters and appeals before administrative law judges with the Office of Medicare Hearing and Appeals, Department Appeals Board, Civil Remedies Division and State Office of Administrative Appeals.

Jack Thompson is a corporate eDiscovery and Legal Operations professional, specializing in the advancement of efficiency of legal technical operations and information governance. From 2007 to 2014, Jack managed Purdue Pharma’s Legal Operations Program focusing on opioid product liability and patent litigation. In 2015, Jack migrated to Atlanta, GA and assumed a Legal technology management position at the United Parcel Service (UPS) managing global legal technology implementations and EDRM processes for the company. After 1 year with UPS, Jack moved to The Coca Cola Company as a IT Business Partner for the Global Legal Department, specializing in technology and process roadmap implementation for TCCC’s global legal landscape.

In 2016, Jack relocated to New Jersey to assume a director position at Sanofi, a global pharmaceutical company, managing global Legal Operations programs focusing on technology management, information governance and financial management within internal and external parties. Jack is now the global Legal Operation Director for Sanofi spanning in multiple areas of work including eDiscovery, Law Firm relationship management, vendor management, and technology roadmap development. Jack has a master’s degree of Business Administration with a focus on global operations and financial management for business and has contributed to legal cost savings and management education programs throughout his career. Jack is a Board member for ILTA and advisory contributor and writer for ACC Legal Operations forums.

Chris is the Head of Global eDiscovery, Digital Forensics, and Incident Response Technology for Juniper Networks based out of Silicon Valley. As a leading innovator in the eDiscovery technology space, he is well known for developing custom defensible solutions to execute on large scale discovery requests and federal investigations for Fortune 100 companies. As a Forensic Expert, Chris has assisted Federal and Local Government, as well as many private law firms with their cases. His consulting and expert witness testimony has led to convictions and settlements in numerous cases involving disputes over digital evidence and electronic data. He has recently completed the development of an entirely cloud based eDiscovery and forensic environment which spans the entire EDRM, can process over 1,000,000 emails a minute, and is in compliance with all international data privacy laws.

Jason R. Baron is a member of Drinker Biddle’s Information Governance and eDiscovery practice.

An internationally recognized speaker and author on the preservation of electronic documents, Jason previously served as Director of Litigation for the U.S. National Archives and Records Administration and as trial lawyer and senior counsel at the Department of Justice. In those roles, Jason helped drive the government’s adoption of electronic recordkeeping practices and defended the government’s interests in complex federal court litigation.

As NARA’s Director of Litigation, Jason led NARA’s efforts to provide responsive White House email and other records in the massive U.S. v. Philip Morris RICO lawsuit, and assisted in the defense of lawsuits filed against the Archivist of the United States under the Freedom of Information Act, the Federal Records Act, and the Presidential Records Act in a wide variety of high-profile cases. As a trial lawyer and senior counsel for the DOJ, he appeared as counsel of record in landmark cases involving the preservation of White House email, statistical adjustment of the U.S. census, and early attempts to regulate the Internet.

Jason is the current Vice-Chair and Chair-elect of the E-Discovery Committee of the D.C. Bar Litigation Section. Additionally, Jason serves on the advisory board of the Georgetown Advanced Institute on E-Discovery, on the board of advisors for the Cardozo Data Law Initiative, and on ARMA’s governance board for the Information Governance Professional Certification Program.
