Appeal from the United States District Court for the Northern District of Texas

Ronald Eugene Henry appeals his conviction for possession of a firearm while subject to a court order in violation of 18 U.S.C. � 922(g)(8), alleging, among other things, that the indictment was defective because it did not allege the scienter element of “knowing” set forth in the corresponding punishment provision of 18 U.S.C. � 924(a)(2). Finding no reversible error with respect to his conviction, we affirm the conviction. Henry also argues that the district court committed plain error in calculating his criminal history category. We agree and vacate and remand for re-sentencing.
