Atlanta lawyer R. Page Powell Jr. is enjoying a rare defense victory in the Georgia Supreme Court’s piecemeal consideration of the 2005 legislation that made it harder for plaintiffs to win suits. But don’t tell him the court’s Nov. 21 ruling on expert testimony in medical malpractice cases was “anti-plaintiff.”

“It applies with equal force to plaintiffs and defendants in these cases, and to me it’s a very fair, very reasonable threshold requirement for expert competency,” Powell said. “I’m not convinced that plaintiffs are more likely to have incompetent experts.”
