The effort to mount a class action against pest control company Rollins Inc. and its subsidiary, Orkin, has suffered a significant setback. The Georgia Court of Appeals has reversed a lower court's decision to certify a class in a case in which plaintiffs claim that Orkin breached its contracts by failing to provide termite inspections. The appellate court found that claims made by the asserted class, which could include "thousands" of plaintiffs, would require highly individualized inquiries.

Former Georgia Gov. Roy E. Barnes’ firm has suffered a significant setback in its efforts to mount a class action against Atlanta pest control company Rollins Inc. and its subsidiary, Orkin.
The Court of Appeals of Georgia has reversed a Cobb County judge’s decision to certify a class in the case, in which Barnes’ clients claim that Orkin breached its contracts by failing to provide termite inspections. The class would have included customers who entered into contracts between 1995 and 2006.
