A federal judge has issued a permanent injunction against the performance at a popular Albany night spot of standards written by George and Ira Gershwin.

Chief Northern District Court Judge Norman A. Mordue also fined the owner of the night club, John DeJohn, $4,744 for copyright infringement for repeatedly allowing “Someone to Watch Over Me,” “The Song is You” and “Summertime” to be played at a jazz club inside his downtown bar Justin’s.
