Supreme Court sources confirmed Friday afternoon that Chief Justice John Roberts Jr. has decided to rejoin the case of Credit Suisse v. Billing , set for argument on Tuesday. Coming on the heels of Justice Anthony Kennedy's own recusal last week, this means a 4-4 split could be possible in the case.

This, after he had recused from the outset of the case — presumably because of assets he holds in some of the companies involved in the antitrust case.
