For California's civilly confined sexual violent predators, participation in optional therapy can have hidden risks, according to defense attorneys. If the offenders divulge information to a psychologist about an unreported offense, they could face new charges or find the information being used against them at a recommitment hearing. But not participating in treatment could be perceived as denial. Defense attorneys say the situation is a Catch-22, and are struggling with how to advise clients on the issue.

In the second phase of sex offender treatment, civilly confined participants must revisit their dark past. They must open up about their past sexual offenses and show a desire to stop harming others. And if that means divulging information about a sexual offense that went unreported, their chances of getting out might be shot, because the information can be used against them.
Yet to not participate can be perceived that they’re in denial.
