When attorneys for the University of Miami asked the Florida’s full 3rd District Court of Appeal to consider overturning an unfavorable three-judge panel ruling in a medical malpractice case, they were probably expecting a simple yes or no on whether the court would take the case.

Most likely, they were expecting to be turned down. Over the past three years, the 3rd DCA has received 368 requests for en banc hearings by the full panel of 11 judges. It has issued a total of 10 en banc opinions in that time.
