A Montana man who was injured in a collision with a drunken driver has filed a negligence claim against the bar that allegedly served the drinks to the underage man. Under Montana law, bars and restaurants are liable if they continue to serve obviously intoxicated customers and then do nothing to stop them from getting into their cars; they can also be held responsible for serving customers under 21. The bar's attorney denied the bar served the underage man, who was a kitchen employee there at the time.

A Montana man who was injured in a collision two years ago with a drunken driver is suing the bar that allegedly served the underage man drinks, accusing the establishment of negligence.
Stephen Reichelt’s lawsuit accuses Hammer Jacks bar in Missoula, Mont., of being “wrongfully and grossly” negligent, saying bar employees served 20-year-old Cody Province mixed drinks, even though they should have known he was already too intoxicated to be served.
