The suit alleged the vehicle's roof was not strong enough; at trial, a plaintiffs lawyer described the part that gave way as "spindly little pieces of metal engineered down to an unacceptable level to save money." The damages assessed against Ford Motor Co. were compensatory, not punitive. The jury did not find that Ford recklessly disregarded its duty to public safety.
