In a case of first impression, a Manhattan Supreme Court justice has held that a former employee did not bring in a timely manner state and city employment discrimination claims originally dismissed without prejudice in a federal court.
The ruling offers cautionary advice to practitioners puzzled by the arcana of overlapping procedure in federal and state courts and the distinctions between terms like “action” and “claim.”
