Texas inmates working prison jobs are not employees and are not entitled to the federal minimum wage of $5.15 an hour, the 5th Circuit has ruled in a case brought by an inmate who works at a state prison laundry. Douglas R. Loving contended his job qualified him for protection under the Fair Labor Standards Act because the act didn't exempt prisoners. The panel noted that other federal appeals courts uniformly have held that "prisoners doing prison work are not the prison's employees."
