Expert witness Thomas Loflin III, a U.S. civil rights lawyer testifying for McKinnon, said the court must be given a diplomatic note of assurance by the United States before it can be satisfied any extradition would not result in such a scenario. Loflin said the alleged hacker faces up to 60 years in prison if convicted on eight counts.

Gary McKinnon, 40, of London, is wanted in the United States over allegations that he illegally accessed 97 computers, including U.S. Army, Air Force, Navy and NASA systems, causing $700,000 in damages.
