The 9th Circuit on Wednesday dealt a blow to plaintiffs lawyers seeking court-ordered fees in small-money cases. Lump-sum settlements that preclude lawyers from seeking separate attorney fees have long been the bane of the plaintiff bar, and California solo Michael Mitchell in particular. Mitchell's latest shot at getting around such settlements -- rejected by the panel -- involved a retainer agreement that transferred a plaintiff's right to seek fees to Mitchell himself.
