It's unclear why there was no drum circle at the 9th Circuit Tuesday. The dozen or so people assembled outside the courtroom seemed to have one thing on their minds: smoking pot. Ed Rosenthal, the group's focal point and something of a marijuana celebrity, was convicted in San Francisco federal court for growing marijuana. Rosenthal appealed because the judge had refused to let the jury hear that the pot was grown for locally sanctioned medicinal use. Rosenthal was licensed to do it in Oakland, Calif.
