In a world of technological advances, former employees are increasingly able to move far away and yet still directly compete with their former employer. State laws relating to noncompete agreements have not kept pace with this new economic reality, and litigants should recognize that the other side may be able to initiate a subsequent lawsuit in another state, and neither side may be able to enforce a judgment beyond the state where it was obtained.
