Judicial discretion may not be in vogue with Congress these days, but it remains so with the 9th U.S. Circuit Court of Appeals. A unanimous panel Monday gave judges broad latitude to decide whether to grant bail pending appeals, telling courts to look at the "totality of the circumstances" in deciding when defendants should finally be imprisoned. The case involved allegations of brutality filed by a U.S. Attorney's Office against two former state prison guards in California.
