A new era of tougher scrutiny of defense lawyers' work in death penalty trials is expected due to an end-of-term U.S. Supreme Court ruling, in which the Court took a major step toward dealing with the persistent issue of inadequate representation for indigent capital murder defendants. Wiggins v. Smith is only the second case in nearly 20 years in which the justices found a death row inmate had received ineffective assistance of counsel under the standards in Strickland v. Washington .
