The Michigan Supreme Court has upheld the constitutionality of a statute limiting lawsuits against drug makers for defective drugs when the drugs have been approved by the U.S. Food and Drug Administration and comply with its labeling requirements. The ruling arose in the appeal of four separate lawsuits filed against makers of the diet drug fen-phen, after trial courts reached opposite results on defendants' motions for summary judgment.
