Frank Murphy has moved in-house as executive vice president and general counsel at Krispy Kreme Doughnut Corp., the doughnut chain. Murphy has been outside counsel to the Winston-Salem, N.C.-based company for more than 20 years as a partner in the Winston-Salem office of Atlanta’s Kilpatrick Stockton. After 30 years of private practice, Murphy said he made the move in-house to help manage the strategic growth of the company. Krispy Kreme, a 75-year-old company that went public in April 2000, is looking to spread its reputation beyond national borders. It just launched its newest store — its 220th — in Toronto and plans to expand into Mexico. Murphy said he wants to be more involved with business operations, rather than just lawyering. “I’ve been counsel to the board,” he said, “but that was more on a project basis.” This will be an opportunity to “see the day-to-day side of the business,” he said. Murphy advised the company during its buyout from Beatrice Foods through a group of franchisees in 1982. Not surprisingly, Kilpatrick Stockton will continue as the company’s principal outside firm. Krispy Kreme will also use Covington & Burling of Washington, D.C., on certain international matters and the New York firm Cahill Gordon & Reindel on some securities issues. Murphy received his J.D. from Vanderbilt University School of Law. He had enlisted in the Army’s ROTC program as an undergraduate, but because Vietnam was winding down as he finished law school, he was able to start working. He began with a Kilpatrick predecessor — a firm of just 15 lawyers — and has watched the successor firm flourish to more than 500 lawyers today. As for Murphy’s favorite of the many scrumptious Krispy Kreme doughnuts offered every day, he’s a “Hot” Original Glazed kind of guy.
