The Pennsylvania Superior Court has remanded a premises liability case to the Philadelphia Court of Common Pleas for an evidentiary hearing to determine whether a judge’s alleged telephone calls and other activities during testimony interfered with the trial.
The appeals court does not identify the judge in its opinion, but the common pleas docket indicates that Judge Marvin R. Halbert was the presiding judge over Dimonte v. Neumann Medical Center and Assets Protection Inc.
