The 9th U.S. Circuit Court of Appeals ruled Monday in Smith v. University of Washington that Seattle's University of Washington Law School acted legally when it considered the race of applicants in admissions. The decision means publicly funded schools throughout the circuit can continue to use affirmative action programs, and also puts the 9th Circuit in direct conflict with the 5th Circuit.
