Brobeck, Phleger & Harrison has come up with a novel response to the flight of attorneys in-house: charge clients a fee for hiring away talent.

Brobeck is obligating its clients to pay 25 percent of the first-year salary of attorneys lured from the firm. A clause was added to the firm’s client engagement letter last month. While the provision goes into effect with new clients, Brobeck says it is discussing the policy with existing clients as well.
