State employees cannot sue their employers in federal court for alleged discrimination under the Americans with Disabilities Act, a split panel for the 7th U.S. Circuit Court of Appeals ruled Monday. Melinda Erickson v. Board of Governors of State Colleges and Universities, for Northeastern Illinois University , No. 98-3614.

According to the majority, the 11th Amendment of the U.S. Constitution simply made states immune to such lawsuits.
