How much is too much for an award of attorney fees under the Pennsylvania Unfair Trade Practices and Consumer Protection Law? A recent opinion from the Superior Court should help trial courts with the answer.
In McCauslin v. Reliance Finance Co., a three-judge panel remanded a trial court’s decision to award plaintiff Daniel McCauslin $12,000 in attorney fees because the court did not consider the amount of time the attorney actually spent on the UTPCPL claim or how much other local attorneys would charge in a similar case.
