Attorneys suing a luxury Sunny Isles Beach, Fla., condominium should be permitted to talk to the media about their case, a Miami-Dade Circuit Court judge ruled Tuesday. Judge Margarita Esquiroz said that she did not perceive communication with the media as a risk to the fair trial rights of the defendants. The request for a gag order was made by attorneys for Oceania condominium, which was sued earlier this year by a Brazilian businessman whose wife and two children were kidnapped last December from the complex’s parking garage. Alceu Aragao, in his suit, alleged that lax security made the kidnapping possible. The request for a gag order grew out of a story that appeared in the Daily Business Review last month outlining the suit and detailing the events of the kidnapping. Attorneys for Oceania and its management had argued that the case should not be tried in the media. The judge said she read the article and found nothing that jeopardized Oceania’s right to a fair trial and that prior restraint could not be entered as a matter of course.
