U.S. District Judge Nancy Atlas of Houston dismissed a defamation caseagainst Houston’s KILT radio sports program “The Bench.” The case stemsfrom an earlier suit filed by Noemi Melendres of Houston to enjoin KleinHigh School from participating in the state football playoffs because itallegedly had an ineligible player on its team. Melendres’ son played on arival high school team, Klein Forest, which stood to make the playoffs ifKlein was disqualified. The station broadcast a parody in which itpurported to contact Melendres’ husband, who revealed that Klein Forestplayers had suffered huge damages, including $400 million in lost NFLsigning bonuses, $10 million per player in the lost opportunity to datehigh school cheerleaders and lost revenues from the sale of pom-pons andfoam fingers. Melendres stated that her husband has been dead for about sixyears. “Would you want me to make fun of your dad if he were dead?” asksMelendres’ attorney, Houston solo Thomas R. Adkins. The station’s attorney,Geoffrey Berg, counters, “If we choose to protect only those parodies thatdon’t offend anybody, we’ll be left with a lot of parodies that make no onelaugh.”
