A federal judge in New York found that measures rendering some convicted felons ineligible for so-called discretionary waivers of deportation do not apply retroactively. The case emerged out of a controversy that arose after Congress passed a series of amendments in 1996 that increased the number of offenses for which an alien could be deported. It also curtailed the discretion of the Attorney General to grant deportation waivers for convicted criminals.

In so ruling, Judge John Gleeson granted habeas corpus petitions to five aliens and vacated their deportation orders in Pena-Rosario v. Reno, 99-CV-4652 et al.
