A federal judge in Brooklyn has found that measures rendering some convicted felons ineligible for so-called discretionary waivers of deportation do not apply retroactively.

In so ruling, Judge John Gleeson granted habeas corpus petitions to five aliens and vacated their deportation orders in Pena-Rosario v. Reno, 99-CV-4652 et al.
