U.S. District Judge James Nowlin of Austin ruled Texas's IOLTA program did not unconstitutionally take a legal client's money. Nowlin, who has presided over the long-running dispute since it was filed almost six years ago, dismissed the challenge to the program with prejudice. Nowlin found there was no 5th Amendment "taking" of property from Williams Summers, a client of Houston attorney Michael Mazzone.
