For two years, Townsend and Townsend and Crew has been battling amalpractice suit brought by former client Jerry Weil. Recently the casetook a new turn when Townsend sought to make Weil’s attorney a witness forits side. Specifically, Townsend requested documents that Douglas Schwartzof San Francisco’s Schwartz & Cera worked on while he was a partner atLillick & Charles. At that time, Schwartz, along with Townsend, wasrepresenting Weil in an antitrust dispute. Townsend apparently believesthat documents within Lillick’s possession can help refute Weil’s chargesthat Townsend committed negligence and fraud in the course of representingother clients. This month, an appeals court overturned a lower court rulingthat had denied Townsend access to the Lillick file. “They are chasingghosts,” Schwartz said. Townsend lawyers either think there’s something inthese documents or “this is a way of harassing or stalling or intimidatingme,” he said. Townsend is “welcome to the Lillickfile,” he added.
