A former hospital administrator, attorney Jay Ziskind has spent recent years matching doctors with management firms and setting up outpatient surgery centers, in the process developing a reputation as a shrewd businessman with a genius for schmoozing doctors. It’s one such deal that now has Ziskind, of Ziskind & Arvin, the target of a lawsuit in Miami-Dade Circuit Court by the Miami-based physician practice management firm Continucare Inc. The suit alleges that Ziskind and his partner, Kenneth Arvin, engaged in an “incestuous” relationship of providing legal advice to Continucare while representing two physician groups that Continucare was buying. The suit claims the lawyers were working both sides of the deals and didn’t disclose their business relationships with the doctors who were selling their practices to Continucare. “It is a classic case of malpractice and breach of fiduciary duty,” said James W. Beasley Jr. of Beasley Leacock & Hauser in West Palm Beach, who represents Continucare. Joseph DeMaria, attorney for Ziskind and Arvin, countered: “This is a classic example of someone who didn’t want to pay an obligation.”
