A nursing home cannot be required to bargain collectively with a group of licensed practical nurses since their job duties show that they have supervisory authority over the home’s certified nursing assistants, a divided panel of the 3rd U.S. Circuit Court of Appeals has ruled.

The court’s ruling in National Labor Relations Board v. Attleboro Associates Ltd. reverses an NLRB order.
