A nursing home cannot be required to bargain collectively with a group of licensed practical nurses since their job duties show that they have supervisory authority over the home's certified nursing assistants, a divided panel of the 3rd U.S. Circuit Court of Appeals has ruled. The majority found that the LPNs do, in fact, use "independent judgment" in exercising their authority to recommend discipline, adjust grievances, and assign and direct the CNAs.
