Calling an attorney’s conduct “beyond the pale” and describing it as “Rambo tactics,” a federal judge in New York has ordered veteran lawyer Judd Burstein to pay a $50,000 sanction. In a blistering opinion, U.S. District Court Judge Denny Chin said Burstein acted like “an attack dog whose sole purpose was to destroy,” in a case alleging overbilling by attorneys Robert W. Cinque and James P. Cinque. Cinque & Cinque represented Rommy Revson, the inventor of the “Scrunchy,” an elastic hairband worn around ponytails. Revson fired the firm, filed suit AND HIRED Burstein to prosecute. The jury found Cinque & Cinque had been discharged without cause and rejected Revson’s extortion claim. Chin assailed the tactics employed by Burstein both pretrial and during trial, which included writing a letter to Robert Cinque threatening to “tarnish” his reputation and subject him to the “legal equivalent of a proctology exam” in discovery.
