The second Circuit Court of Appeals has ordered a new trial in a case where a plaintiff secured a $1 million judgment against the Bridgeport, Conn., Roman Catholic diocese for sexual molestation by a priest that he allegedly suffered in the early 1960s.
The court, which split 2-1, said that the plaintiff must go back to the trial court to prove facts to justify the filing of the lawsuit more than three decades after the alleged abuse.
