John L. Warden, of New York’s Sullivan & Cromwell, must feel like a guy who won an instant-lotto prize while waiting for the main lottery jackpot drawing. Warden is lead defense counsel in the government’s landmark antitrust case against Microsoft Corp., the first antitrust case said to occur on Internet time. While awaiting the Microsoft decision, he has won an antitrust victory for another client, British Airways P.L.C., in a suit that has been dragging on for six years. The ruling for British Airways came down the old-fashioned way: The judge heard arguments on British Airways’ summary judgment motion in January 1998. She threw out claims by Virgin Atlantic Airways Ltd. that British Airways abused its lock on London’s Heathrow Airport, where it has 39 percent of the runway slots, to cut “incentive” deals for travel between Heathrow and five U.S. cities.
