Eastern District Judge Nina Gershon made it clear yesterday that Mayor Giuliani’s decision to stop funding the Brooklyn Museum of Art in the wake of the “Sensation” exhibition violated the Constitution.

Agreeing with virtually every argument offered by lawyers for the museum, Judge Gershon refused to abstain from exercising federal jurisdiction in the face of a state eviction proceeding, and granted a preliminary injunction that restores withheld city funding.
