A Florida appellate court reversed its own reversal and will allow a civil jury to consider a lump sum for punitive damages in a suit by smokers and their families against the tobacco industry. The same jury already found that the industry produced a dangerous and defective product. Industry spokespersons reviled the decision saying punitive damages could reach $300 billion, enough to ruin the industry. Wouldn't that be a shame?
