A woman who contracted theHIV virus through a 1984 blood transfusion at Lenox Hill Hospital may proceedwith her lawsuit against the hospital despite being time-barred, a ManhattanSupreme Court justice has ruled.

Justice Lorraine S. Millerfound that although the three-year statute of limitations had expired longbefore the 1998 filing of the suit, the plaintiff, Ellen Fuchs, was entitledto proceed because Lenox Hill had induced her not to file a timely suitthrough purposeful concealment and misrepresentation.
