Finding that a prosecutor improperly “vouched” for two keygovernment witnesses, a federal appeals court has ordered a new trial in a criminalprice-fixing case against a plastic cutlery manufacturer and one of its top executives.

In the case, Dispoz-O-Plastics Inc. and its president and CEO, PeterIacovelli, were accused of meeting with the heads of two of their competitors — AmcelCorp. and Polar Plastic Manufacturing Ltd. — and agreeing to fix the prices for plasticknives, forks, spoons and “sporks,” in contracts with the nation’s major airlines.
