Sex discrimination claimsmay be submitted to mandatory arbitration under a National Associationof Securities Dealers registration agreement, a U.S. Court of Appeals forthe Second Circuit panel has ruled in a case of first impression.

The issue of whether TitleVII discrimination can be arbitrated is one that has caused a split amongthe federal circuit courts. In its holding announced last week, the SecondCircuit joined the overwhelming majority of jurisdictions favoring arbitration.
