Juries should be guided by some kind of mathematical formula in determining damage awards, attorney Keithley D. Mulvihill argued before the Pennsylvania Supreme Court. Without such a formula, awards may have no relation to a plaintiff's losses, he said. At issue before the court is the validity of so-called "compromise verdicts" since adoption of the comparative negligence statute. Juries have long had the power to compromise on damage awards, and judges usually have deferred to those awards.
