The Appellate Division, FirstDepartment, has overturned a $2.5 million verdict stemming from an industrialaccident because the trial judge erred in ordering a directed verdict onthe question of liability.

All five judges on the appellatepanel agreed Manhattan Justice Stephen G. Crane erred when he ordered thedirected verdict, but one of the judges dissented from the panel’s decisionto order a new damage trial.
