The 5th U.S. Circuit Court of Appeals on Wednesday dismissed a tobacco suit brought by the family of a Texas smoker who died of throat cancer.

In Sanchez v. Liggett & Meyers, Inc., the court held that a 1993 Texas statute precludes suits alleging damages from cigarettes and other products “known to be unsafe by the ordinary consumer.”
