Holding that a 1993 Texas statute precludes suits alleging damages from cigarettes and other products "known to be unsafe by the ordinary consumer," the 5th U.S. Circuit Court of Appeals dismissed a tobacco suit brought by the family of a Texas smoker who died of throat cancer. The State of Texas' settlement with tobacco companies in 1998 does not preclude individual smoking claims, but such claims will prove difficult in light of the 5th Circuit's precedent.

The 5th U.S. Circuit Court of Appeals on Wednesday dismissed a tobacco suit brought by the family of a Texas smoker who died of throat cancer.
In Sanchez v. Liggett & Meyers, Inc., the court held that a 1993 Texas statute precludes suits alleging damages from cigarettes and other products “known to be unsafe by the ordinary consumer.”
