Claiming that a $975,000 settlement of a fatal car accident suit was deliberately structured so that an ERISA plan would be unable to collect its lien for medical expenses, lawyers for the plan have filed suit in U.S. District Court against the widow and her lawyer.

In response, the lawyer and the widow filed third-party suits against two other lawyers, accusing them of negligence for failing to inform them that the plan would bring such an ERISA claim.
