Those of you who are poised for -- or already embroiled in -- civil litigation should consider a New Year's "resolution" for the new millennium: voluntary use of mediation. The mediation process works particularly well in the targeted industries of entertainment, media and technology, in which intellectual property disputes often arise. With the widespread growth -- and success -- of ADR, including mediation, litigation's status as the first choice for resolving disputes is being re-evaluated.
