A split panel of the U.S.Court of Appeals for the Second Circuit has reversed a denial of classcertification in a racial discrimination lawsuit against the Metro-NorthCommuter Railroad brought by its black employees.

On Friday, the appeals courtmajority, in an opinion by Circuit Judge Jon O. Newman, reversed a May1998 decision by Southern District Judge Jed S. Rakoff, who denied classcertification in the case because there was a lack of commonality and typicalityamong the proposed class members’ claims.
