Dark questions about the fate of the Ninth Circuit U.S. Court of Appeals and its judicial nominees have clouded the most recent Ninth Circuit judicial conferences. But the tone as the 1999 conference opened Monday was a bit lighter than in years past. Chief Judge Procter Hug Jr. -- though he warned that "this is not a troubled circuit" -- was happy to emphasize that a full-on split of the court into two or three different circuits is no longer on the agenda of even the harshest congressional critics.
